a game producer doesn't Need permission to artistically make a approximation of a building that Looks like this ... i don't think they'll stand a chance in court with That one ... it's a game , stop crying , grow up , make some money out of it ???

This is the airport level all over again. It's pretty clear activision doesn't give a crap, they even ship the disc version with DRM only.

Most of us had probably never heard of the Conservatorium Hotel until reading this story. Yesterday it was just some location in a game, today it is advertising across numerous media outlets. It's great PR spin from the hotel and I bet you dollars to doughnuts bookings are being made as I type this reply.

It's neat that Activision can turn your benign business/building with incredible architecture into a virtual shooting gallery and gamers just gleefully support it like "wat?". sigh

They complained so that you knew who they were because until they did there was probably little connection between their likeness in a game and the actual location.

If Activision didn't ask, or payed, for permission, then they have reason on their side. Imagine if they decided to create the main villain with your face and name, without your consent, would you be okay with that?

I actually walked past that building, and stayed close to this once for a week. I'd have no idea the name's of an existing hotel, even if I played this particular cod game. Oddly enough, they usually take names that are not used just for the reason to avoid having to pay for that. I guess somebody did not check.

@anthos doesnt matter. past has shown changing the name is not enough to be legally fine. would you be if your face would be shown on house sized ads with the name "$hole" below it?! (you know, they changed the name..)

Companies aren't happy to be randomly presented in games, unless they specifically agreed to it in a formal deal, because they are protecting their narrow and very cafefully maintained corporate image. This is not that different from Youtube mistreating weapon/war related channels, for example, because Youtube's first priority is to please the advertisers' every whim. In a full circle, the advertisers try to maintain their narrowly defined image, so they don't want their name to appear in anything they deem even 1% suspicious in the eyes of 1% of potential customers. On the other hand, if you don't defend your intellectual property, you eventually lose it.

I'm actually on their side on this: if my property or place of business was in a f'king CoD title, I would want it immediately removed. They could put a sexual reassignment surgery there if they want, as a replacement 3D model, no problemo with that, but not my properties or, place of business. The blazes with that notion. GTA = fine, that's just fine by me, because it's a satirical game, poking fun at the establishment (even though RockStar became the very thing they were poking fun at) and that's hunky-dory/funky-monkey in my mind. A Call of Duty game? Hell's no 'bro, hell's no.

The name is not the only thing that can be used to identify a whole building. Maybe they can sue for damages for reputation and brand name. Or there might be some art unique to the building, or it's interior.
