I don't think they really need to. Sony knows that their patches will eventually just get broken again anyway (so it isn't worth the effort to stop), and they can always encourage game devs to break compatibility or banning from online play for "anti-cheat" purposes.
They will patch, the majority of patches are security related. Whenever you see the vague "improves system performance" its a masked security patch.
