It's very common and people usually don't talk about it. I remember one of my GPU in the past came with hynix memory while other GPUs of the same model would ship with samsung memory and the samsung memory would overclock better (but the hynix memory would run at the advertised speed). As long as the advertised performance is meet it's not a problem imo.

i would love to see someone going to court, as even IF there is a noticeable difference in REAL WORLD use (e.g. not benching), all companies state that performance will/can change, even if identical hw is used (like they did), when the manufacture benched it. so zero legal ground for change in hw, nor for performance.

quite true. but then there's "the court of the market",, where advertising affects perception. not all prices paid are immediate or tangible at first. eroding the confidence of the end user is never good despite being legal.

and thats where ppl with working gray matter make a decision. then again, the masses will probably never know, as the byo market isnt that big (vs rest)
