So bad 🙂 If the action come from users ok, but a lawyer that probably does not even do gaming is just running behind money.

...And that's what lawyers do...

Nvidia will settle with the lawyers for millions while the consumer will get pennies.

As a shop owener , this is bad for business. If a recall policy is issued , that would lead to more damage lol. Although , as a gamer , I really don't like the idea of buying something broke

I got $30 from one last year, for TV panel price fixing that occurred in Canada about 6 years prior. The big panel makers got together and price fixed. I wouldn't even have known there was a payout if one of the 'Deals' sites I visit had not posted about it. But ya these things take years. Nvidia has been in one before and lost, the biggest part of the payout went to the laptop makers who had to RMA and fix it. Naturally the law firms want their cut, 20% - 30%. To me it is good, civil liberties shouldn't be abused.

Fascinating that you say you widely explained things you don't seem to have actually even tested! What am I talking about? Look here: Picture too big and not in JPEG format. So you tested the wrong thing, then say there's no issue because of apparently not testing the problem in the first place. Interesting.

By the time you get your money that 970 is going to be an 8800gtx in terms of new cards.

http://www.bursor.com/wp-content/uploads/2014/07/081314_BF_headshots_0004_Neil-571x338.jpg Neal J. Deckant In 2007, Neal graduated with Honors from Brown University with a B.A. in East Asian Studies and Philosophy. 64 ROPS and L2 cache size are both highly technical features, they are in no way indicative of product performance, hell they are not even advertised. You'd have to have a PhD in Maxwell to be swayed by L2 and ROP count. For example GTX 750 has 2MB of L2, GTX 960 has only 1MB of L2, yet GTX 750 << 960 hahaha As for 4GB, yes 970 has 4GB of usable VRAM which is more then say 6GB HD 7990. These are hard numbers, they can't be bargained with. LOOL Nvidia's lawyers will chew them up one by one starting with Neil East Asian Studies guy
To establish that an advertisement is false, a plaintiff must prove five things: (1) a false statement of fact has been made about the advertiser's own or another person's goods, services, or commercial activity; (2) the statement either deceives or has the potential to deceive a substantial portion of its targeted audience; (3) the deception is also likely to affect the purchasing decisions of its audience; (4) the advertising involves goods or services in interstate commerce; and (5) the deception has either resulted in or is likely to result in injury to the plaintiff. The most heavily weighed factor is the advertisement's potential to injure a customer. The injury is usually attributed to money the consumer lost through a purchase that would not have been made had the advertisement not been misleading. False statements can be defined in two ways: those that are false on their face and those that are implicitly false.
As a consumer, I want someone who knows how to put up a case. I've got no problem having good lawyers taking care of this. Doesn't matter to me as a gamer if they are or aren't.

An class action lawsuit always leaves the customer with only pennies on the dollar, and the bloodsucking lawyers with the big bucks.

"If you purchased an NVIDIA GTX 970" How could you take them serious when you would think, they could use proper grammar... It's A NVIDIA GTX 970 not AN NVIDIA GTX970. Jesus wept!

So your angry that a civil liberties law firm took up a case that protects consumers?
data/avatar/default/avatar30.webp
Good thing this is happening. The lawyer has to have legal competency, he can learn and understand what ROPs and cache are, for lawsuit purposes generic info is enough. Let me put this straight: performance has no impact (although there is stuttering around and above 3.5Gb VRAM) in this matter and customer disappointment. What matters is the fact that we were deceived, on purpose or not, irrelevant again. When you break the eggs, you take responsibility and pay for your mistakes, accident or not. We bought 4 GB VRAM with 64 ROPs cards. We want EXACTLY what we bought, not 3.5 good VRAM and 0.5 slow ****ty VRAM. Also irrelevant is what customers get at this point. I for one, in Europe, won't get ****, but still want to see nVIDIA punished and this go public. That's about it.

From a Law Firm like this who's only business is to sue companys "on behalf" of consumers, yes I am angry. I'm really curious how pocketing millions of dollars and distributing pennies to the consumers helps us at all. Just look at their amazing history. http://www.bursor.com/news/ Seriously these people have no other business other than frivilous lawsuits that waste millions of taxpayer dollars. My favorite is the Scotts EZ Seed
On May 22, 2013, Judge Vincent Briccetti of the United States District Court for the Southern District of New York denied defendants’ motions to dismiss and allowed class action claims against the makers of Scotts EZ Seed Turf Builder, as well as retailers Home Depot and Lowe’s, to move forward toward class certification. The lawsuit involves allegations that EZ Seed does not grow grass based on independent studies in which the product failed to grow a single blade of grass. “We are pleased that Judge Briccetti allowed this case to move forward so that purchasers of this defective grass seed can seek class certification,” said Joseph Marchese, one of the firm’s partners handling the matter.
