Asetek Loses Patent Infringement Case Cooler Master In The Netherlands

The Hague Court in the Netherlands destroyed a patent claim from Asetek, involving Cooler Master for 'lack of inventiveness'. Asetek stated that Cooler Master infringed their patent with the Nepton 120XL, Nepton 240M and Seidon 120V V2. Danish Asetek demanded a sales stop.



In response to the claim, Cooler Master asked the court to declare the petent invalid. The Hague's court has validated Cooler Master's argument that they too have a similar patent to Asetek's with what they call a "utility model" which already exists in China, which describes (and patents really show their problems here) the "operation of a water pumping engine device with chamber". 

The case concerned the patent EP 1 923 771 , filed by Asetek in November 2004 and awarded in May 2015. The European patent is based on an older American patent(s) of Asetek. Danish Asetek has been running a legal battle with Cooler Master for many years now and in 2015  a US court ruled a similar case in favor of Asetek which resulted in penalties in the 5 figure numbers.
